Terms & Conditions

By creating an account, accessing, or using BallerConnect (the "Platform"), you agree to be bound by these Terms & Conditions ("Terms") and the BallerConnect Privacy Policy, including the Children's Privacy provisions.

These Terms form a legally binding agreement between you and BallerConnect. If you do not agree with these Terms, you may not access or use the Platform.

If you are using BallerConnect on behalf of a minor, you represent that you are the minor's parent or legal guardian or otherwise have the legal authority to bind the minor to these Terms, and you accept these Terms on the minor's behalf.

BallerConnect may be used by baseball and softball players, parents, guardians, coaches, teams, organizations, and other authorized users. Age requirements help protect younger users and comply with applicable children's privacy laws, including the Children's Online Privacy Protection Act ("COPPA").

Users Under 13

Users under 13 may only participate through a parent- or guardian-controlled or properly authorized account or profile where required by applicable law. BallerConnect does not knowingly permit a child under 13 to create an account or submit personal information without verifiable parental consent where COPPA requires it.

Users Ages 13–17

Users ages 13 through 17 must have appropriate parent or legal guardian authorization where required by applicable law. A parent or guardian is responsible for supervising the minor's use of the Platform and for any content the minor submits.

Users 18 and Older

Adults creating or managing accounts or profiles for minors represent that they are the minor's parent or legal guardian or otherwise have appropriate legal authority and permission to do so.

These age requirements are consistent with BallerConnect's Children's Privacy and COPPA policies described in the Privacy Policy.

Parents and guardians are responsible for supervising minors' use of BallerConnect and for managing youth accounts or profiles when applicable.

Parents and guardians are responsible for determining what player information, photographs, videos, statistics, team information, and other content should be shared through a youth profile, and for considering the privacy and safety implications of making that content available to others.

BallerConnect encourages parents and guardians to review profile settings and to contact BallerConnect with any concerns regarding a minor's information.

You agree to provide accurate, current, and complete information when creating an account and to keep that information accurate.

You are responsible for:

• Protecting your login credentials and not sharing them with others;
• All activities conducted through your account;
• Maintaining accurate account information; and
• Immediately reporting any unauthorized access or use of your account to BallerConnect.

Account impersonation and intentionally false identities are prohibited. You may not create an account for another person without their legal authority or represent yourself as another person, team, or organization without authorization.

BallerConnect allows users to create player profiles containing baseball or softball-related information. Profiles may contain information such as:

• Player name
• Age or graduation year
• Team
• Position
• Statistics
• Athletic achievements
• Biography
• Photos
• Videos
• Other baseball or softball information

Users are responsible for ensuring they have permission to publish information concerning another person, including minors, and that the information is accurate and lawful.

These rules govern posts, photos, videos, comments, messages, player statistics, team information, biographies, and other content uploaded to BallerConnect (collectively, "Content").

Users retain ownership of their original Content. By uploading Content to BallerConnect, you grant BallerConnect a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically process that Content as reasonably necessary to operate, promote, maintain, and improve the Platform. This license does not transfer ownership of your Content to BallerConnect.

You represent that you have all necessary rights to the Content you upload and that the Content does not violate these Terms or the rights of any third party.

You may request deletion of your Content or account subject to these Terms and the Privacy Policy. BallerConnect may retain backup copies of deleted Content for a reasonable period as part of its normal system operations and as permitted by applicable law.

Users uploading photographs or videos containing minors represent that they have appropriate authorization or permission to upload and share that content, including from a parent or legal guardian where required.

BallerConnect reserves the right to remove content involving minors when there are privacy, safety, legal, or authorization concerns, and to take further action under these Terms where appropriate.

To protect the BallerConnect community, the following conduct is prohibited:

• Bullying, harassment, threats, or hate speech;
• Sexual or sexually exploitative content;
• Grooming or predatory behavior;
• Inappropriate communications with minors;
• Fraud, scams, or impersonation;
• Spam or unauthorized mass communications;
• Illegal activity;
• Posting another person's private information without authorization;
• Attempts to obtain inappropriate personal information from minors;
• Uploading content without appropriate rights or authorization;
• Circumventing platform safety controls;
• Unauthorized scraping or automated collection of user information; and
• Hacking, distributing malware, or otherwise interfering with BallerConnect.

BallerConnect may offer messaging, comments, and other communication features. Users are expected to communicate respectfully and lawfully.

Additional protections apply to communications involving minors. Adults may not use BallerConnect to solicit inappropriate relationships, sexual communications, private meetings, or inappropriate personal information from minors.

BallerConnect may restrict messaging privileges, investigate reports, and suspend or terminate accounts when reasonably necessary for platform safety.

Users can report accounts, messages, posts, photos, videos, comments, and other inappropriate behavior to BallerConnect. Where available, users may also block other users from communicating with them.

Users are encouraged to immediately report any behavior that may threaten the safety of a minor. BallerConnect will review reports and take appropriate action under these Terms.

Coaches, teams, leagues, organizations, and administrators using BallerConnect are responsible for their own representations and activities, including the accuracy of team information, schedules, and contact details they provide.

Unless specifically stated otherwise, BallerConnect does not independently verify every coach, team, organization, player statistic, credential, or representation made by users.

BallerConnect does not guarantee:

• Team placement or playing time;
• Scholarships or recruiting opportunities;
• College admission;
• Professional opportunities;
• Player development outcomes; or
• Athletic performance.

Connections or opportunities resulting from BallerConnect remain the responsibility of the participating users and organizations.

BallerConnect cannot control interactions that occur outside the Platform. Parents and guardians should supervise minors' offline interactions and independently evaluate coaches, teams, organizations, training providers, events, and other users before participating in offline activities.

BallerConnect does not guarantee the identity, background, qualifications, safety, or intentions of every user unless expressly stated otherwise.

The BallerConnect name, logo, branding, software, website and app design, original graphics, proprietary technology, and other intellectual property are owned by or licensed to BallerConnect and protected by applicable laws.

Users may not copy, reproduce, distribute, reverse engineer, or commercially exploit BallerConnect intellectual property without authorization.

BallerConnect respects the intellectual property rights of others and expects users to do the same. If you believe that content on BallerConnect infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act (DMCA).

A valid DMCA notification must include:

• A physical or electronic signature of the copyright owner or an authorized agent;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material that is claimed to be infringing and its location on BallerConnect;
• Your contact information, including an email address;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
• A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

DMCA notifications may be submitted to the copyright contact listed in the Contact Information section below. BallerConnect will process valid notifications in accordance with applicable law and may terminate accounts of repeat infringers.

Use of BallerConnect is subject to the BallerConnect Privacy Policy, including the Children's Privacy provisions. The Privacy Policy describes how BallerConnect collects, uses, and protects personal information.

BallerConnect does not claim to be "COPPA certified," "GDPR certified," or otherwise formally certified unless such certification has actually been obtained.

BallerConnect may offer optional paid subscriptions or premium functionality. Where offered, the following terms apply:

• Billing: You are billed in advance for the subscription period you select.
• Subscription periods: Subscriptions are offered on a monthly or other stated basis.
• Automatic renewal: Where applicable, subscriptions renew automatically at the end of each billing period until canceled.
• Cancellation: You may cancel at any time; cancellation stops future renewals but does not refund the current period.
• Refund policies: Refunds, where available, are governed by the terms disclosed at the time of purchase and applicable law.
• Pricing changes: BallerConnect may change pricing with appropriate advance notice where required by law.
• Taxes: You are responsible for any applicable taxes on your purchases.

Free accounts may be available, and users are not required to purchase a subscription unless a particular premium feature expressly requires one. BallerConnect does not require team administrators or other users to purchase a subscription unless that requirement actually exists in the product.

BallerConnect may restrict, suspend, or terminate accounts for:

• Violations of these Terms;
• Safety concerns;
• Fraud, abuse, or illegal activity;
• Risks to minors; or
• Attempts to circumvent platform protections.

BallerConnect has discretion to act immediately where reasonably necessary to protect users or the Platform.

Users may request deletion of their account and associated personal information as described in the Privacy Policy. Parents and guardians may make appropriate deletion requests concerning youth accounts or profiles as required by applicable law.

BallerConnect may integrate with or link to third-party services. BallerConnect is not responsible for independent third-party services or their terms, content, security, or privacy practices. Users should review the terms and policies of those services before using them.

To the maximum extent permitted by applicable law, BallerConnect and its content are provided on an "as-is" and "as-available" basis. BallerConnect disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot legally be excluded.

BallerConnect does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any content or information is accurate, complete, or reliable.

To the maximum extent permitted by applicable law, neither BallerConnect nor its affiliates, officers, employees, or agents shall be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the Platform.

To the maximum extent permitted by applicable law, BallerConnect's total liability for any claim arising out of or related to these Terms or the Platform shall not exceed the amount you paid to BallerConnect during the twelve (12) months preceding the event giving rise to the claim, or, where no payment was made, a reasonable amount as determined by applicable law. Nothing in these Terms limits liability that cannot lawfully be limited, such as liability for gross negligence, willful misconduct, or violations of applicable consumer-protection law.

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless BallerConnect and its affiliates, officers, employees, and agents from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: your violation of these Terms; your unlawful content or conduct; your misuse of the Platform; or your infringement of third-party rights, including intellectual property rights.

BallerConnect is a U.S.-based company. The governing law and jurisdiction for disputes arising out of or related to these Terms or the Platform shall be determined in accordance with applicable law and the jurisdiction specified by BallerConnect's legal counsel.

Before pursuing formal dispute resolution, parties are encouraged to attempt to resolve disputes informally. Additional dispute-resolution procedures, including any arbitration or forum provisions, will be specified by BallerConnect following review by qualified legal counsel.

BallerConnect may update these Terms as the Platform evolves or as legal requirements change. When material changes are made, BallerConnect will provide appropriate notice as required by applicable law.

The "Effective Date" and "Last Updated" dates below identify the most recent revision. Continued use of BallerConnect after changes take effect constitutes acceptance of the updated Terms.

If any provision of these Terms is determined to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining Terms shall remain in full force and effect to the extent permitted by law.

These Terms, together with the Privacy Policy and any other applicable BallerConnect policies referenced herein, constitute the entire agreement governing your use of the Platform and supersede any prior agreements regarding that use.
